Congress demands the adoption of specific legislative provisions to ensure that workers do not suffer discrimination or penalty from their employer either because they are a union member or activist, or for revealing illegal or unethical practices in the workplace. Such legislation should comprehend all workers including temporary, part time and agency staff, and should include strong sanctions that effectively deter employers from discriminating against whistle-blowers and union members and activists. The legislation should outlaw any form of adverse treatment that occurs as a result of genuine and non-vexatious whistleblowing, or because a worker is a member of a trade union, practices their right to organise, communicates or advocates on behalf of their union, or seeks union representation to pursue their interests and entitlements under employment rights legislation. The protection should outlaw discrimination or adverse treatment in the recruitment process, at work, and after employment has ceased.
